Abstract

Il contributo intende approfondire il canone di proporzionalità in quanto principio di carattere generale del diritto comunitario, e dunque dell’ordinamento interno, nonché applicarlo nell’ambito della fase istruttoria del procedimento di accertamento tributario. In definitiva l’Amministrazione finanziaria dovrebbe adoperarsi al fine di adottare gli strumenti istruttori più adeguati e tollerabili rispetto al fine perseguito con riferimento alla idoneità, necessarietà ed adeguatezza. Significativa appare, al fine di segnalare una eventuale sproporzione, l’ istituzionalizzazione del contraddittorio nella fase procedimentale che può consentire al contribuente di sollevare eventuali censure con riferimento alla intensità dei mezzi adoperati dall’Amministrazione finanziaria.
