Il regionalismo differenziato

Abstract

Obbiettivo di questo contributo é quello di capire come il regionalismo differenziato possa essere realizzato senza incidere sull’unità ed indivisibilità giuridica ed economica della Repubblica, tenendo conto che l’art. 116.3 Cost. non vive di vita autonoma, ma nel contesto di un più ampio disegno autonomistico, che parte dall’art. 5 Cost e che ora si completa in particolare con gli art. 117, 118 e 119 Cost., che caratterizzano ed indirizzano anche le nuove asimmetrie. D’altra parte, l’autonomia porta di per sé come conseguenza la differenziazione, ma si deve trattare di una differenziazione che non vada contro i principi costituzionali ora richiamati e contro la tutela dell’eguaglianza formale e sostanziale dei cittadini, già messa in serio dubbio con l’attuale assetto dell’autonomia regionale.
