Abstract

Gli istituti sottoposti ad analisi, sulla base dei contributi di numerosa dottrina ed infinita giurisprudenza, sono la oblazione (sia quella prevista dal codice penale che quelle "speciali") e la sospensione condizionale della pena. Si tratta di strumenti oggetto di costante attenzione da parte del legislatore, incapace di approdare ad un equilibrio normativo sufficiente.
