Abstract

L'articolo discute criticamente alcuni aspetti centrali della teoria del diritto elaborata da Manuel Atienza in diversi lavori, specie nel suo recente volume Diritto come argomentazione. In particolare, vengono analizzate e criticate le tesi di Atienza in tema di “is-ought question”, unità del ragionamento pratico, e oggettività della morale. Sono discusse altresì le opinioni di Atienza in merito allo status metodologico della scienza giuridica.
