Abstract

El ensayo analiza y critica, en un nivel teórico, la postura de Luigi Ferrajoli según la cual los derechos fundamentales, contenidos en las modernas constituciones democráticas, son compatibles entre sí, y presenta argumentos a favor de una diversa y contrapuesta postura. Las dos posturas se basan a su vez en dos diferentes maneras de concebir la teoría del derecho: normativa la primera, descriptiva la segunda.
