Impatto sociale dell’attività di impresa: modelli regolativi

Abstract

Il contributo affronta criticamente diversi possibili modelli regolativi dell'impresa, sotto il profilo dell'impatto generato sui diritti fondamentali dei lavoratori. I modelli regolativi basati sul rischio non si affidano all'autoregolazione dell'impresa, ma conservano tratti di regolazione eteronoma. La discipline fondate sulla gestione del rischio tollerano tuttavia rischi "accettabili", sovente non circoscritti con precisione. La valutazione di impatto sociale delle attività imprenditoriali non è “la” soluzione dei problemi del lavoro, e nessun modello di regolazione, di per sé, è sufficiente per garantire il rispetto dei diritti fondamentali, ma i diversi modelli di regolazione dei mercati possono contribuire a rendere più trasparenti le scelte economiche (a livello micro come a livello macro) consentendone una valutazione in termini sociali.
