In the decision under exam, the Italian Supreme Court emphasises that the prerequisite for excluding the offensive dimension of pornography for personal use is the fact that the material produced is intended to remain in the sphere of exclusive availability of the parties to the relationship (holders of a peculiar right of "ius excludend"i). Thereafter, the Court highlights that, in the absence of exploitation and abusive use, criminal relevance under article 600 ter, co.1, can be excluded by the free consent of the minor. Finally, the judgment specifies that the initial consent (neither vitiated nor conditioned by abusive exploitation) to the sexual act does not extend to the phase of any subsequent recording or resumption of these activities
