La cuestión del tiranicidio en la Escuela jesuítica: Suárez y Mariana

Abstract

El principio según el cual el derecho a la legítima defensa tiene prioridad absoluta no se enuncia expresamente en Vitoria, ni en Suárez. No obstante, ningún Estado puede renunciar a este derecho porque no tiene potestad para decidir sobre el mismo, en cuanto que es un derecho natural y supera la disponibilidad de poder por parte de la comunidad política. Este punto fundamental, en la reflexión sobre el tiranicidio, revela la diferencia y la novedad propia de la especulación de Juan de Mariana respecto a la tradición anterior, no solamente jesuítica. Mariana pone de relieve cómo el mismo ciudadano puede hacer valer directamente, también con el tiranicidio privata auctoritate, los propios derechos en contra del príncipe que gobierna tiránicamente si la sentencia ha sido emanada por la comunidad política, aunque, solo como vox populi.

The principle according to which the right to legitimate defense has absolute priority is not expressly stated in Vitoria, nor in Suárez. However, no State can renounce this right because it does not have the power to decide on it, since it is a natural right and exceeds the availability of power by the political community. This fundamental point, in the reflection on tyrannicide, reveals the difference and the novelty proper to Juan de Mariana's speculation with respect to the previous tradition, not only Jesuit. Mariana highlights how the same citizen can directly assert, also with the tyrannicide privata auctoritate, his own rights against the prince who rules tyrannically if the sentence has been issued by the political community, although, only as vox populi
