Abstract

I quesiti che il libro pone al centro del dibattito sono i seguenti: è possibile trovare un giusto equilibrio tra interessi pubblici e privati nella pianificazione del territorio? Si può superare la tradizionale discriminazione tra proprietari tipica della zonizzazione del piano regolatore per ricercare una "giustizia perequativa"? Si può ridurre il peso della rendita fondiaria ed edilizia a favore di meccanismi tesi alla "cattura di valore" che i proprietari ricavano dall'edificabilità delle aree in funzione della costruzione della città pubblica? L'opera si propone di rintracciare nel dibattito culturale, nelle attuali esperienze di pianificazione comunale e sulla base della giurisprudenza amministrativa e costituzionale, i segnali di un'urbanistica "solidale" per ottenere una migliore qualità dei luoghi di vita e di lavoro nelle nostre città, pur in assenza di una legge di principi sul governo del territorio, la cui attesa è lunga quanto la storia della nostra repubblica.
