Abstract

Originariamente concepita dal Consiglio d’Europa come elemento complementare della Convenzione Europea dei Diritti dell’Uomo (CEDU), a difesa dei diritti sociali dei cittadini, il suo cosiddetto pendant sul piano sociale, la Carta Sociale Europea (CSE), adottata a Torino nel 1961 e pressoché dimenticata per un trentennio, è stata rivista e rilanciata negli anni Novanta del secolo scorso. La Carta Sociale Europea Riveduta (CSER) è stata infatti elaborata da un apposito Comitato (CHARTE-REL) tra il 1990 e il 1994 e il Comitato dei ministri del Consiglio d’Europa nel 1996 ne ha approvato il testo, aprendolo alla firma il 3 maggio dello stesso anno. L’Italia ha ratificato la CSER nel 1999 (legge 30/1999). La revisione della CSE del 1961 è stata voluta sia per dare adeguato seguito all’evoluzione dei diritti sociali ed economici in Europa, sia per poter rispondere concretamente ai problemi sociali non considerati dagli altri strumenti internazionali in vigore. Il Protocollo addizionale del 1988, con l’aggiunta di nuovi diritti, il Protocollo del 1991 e soprattutto il Protocollo del 1995, che ha introdotto un efficace sistema di reclami collettivi, avevano del resto anticipato l’intento riformatore del Consiglio d’Europa. La CSER va gradualmente sostituendo la CSE, giacché gli Stati che originariamente hanno aderito ad essa stanno a poco a poco ratificando la Carta riveduta.
