Abstract

La sentenza annotata affronta alcuni degli aspetti maggiormente dibattuti in tema di garanzie bancarie autonome: il problema dell'escussione fraudolenta delle stesse; i casi in cui le vicende del rapporto sottostante possono eccezionalmente assumere rilievo per paralizzare l'escussione fraudolenta; i casi in cui l'escussone può essere paralizzata invocando le eccezioni derivanti dall'accordo garante-beneficiario.
