Le prospettive della Carta sociale europea

Abstract

Questo studio ha l’obiettivo di mettere in evidenza le opportunità offerte a livello nazionale ed europeo dalla Carta sociale europea. L’attuale processo per la realizzazione della piena tutela dei diritti umani nell’Unione europea è caratterizzato dalla non adesione della stessa alla Carta sociale europea (CSE) e alla Carta sociale riveduta (CSER). A sua volta l'analisi della Carta di Nizza permette di identificarne varie lacune riguardo ai diritti e ai principi sociali ed evidenzia la loro problematica effettività negli ordinamenti nazionali. Questo lavoro offre diverse prospettive interpretative, evidenziando varie peculiarità procedurali e concentrandosi sugli elementi più rilevanti per quanto riguarda l’applicabilità e la giustiziabilità della CSE e della CSER. In questo contesto, l'armonizzazione giurisprudenziale passa attraverso l'interazione della CEDU con la CSE e la CSER e stimola un interessante confronto giurisprudenziale e concettuale con le disposizioni italiane in materia di diritti sociali, a partire dalla Costituzione.
