Abstract

Il contributo, partendo dal commento dell'articolo 1177 cod. civ., esamina il ruolo della custodia, nel sistema di diritto privato italiano vigente, ora come semplice prestazione ora come causa entro la categoria dei contratti di consegna e quelli di restituzione, nonchè come criterio di imputazione dell'inadempimento, nel diritto romano classico.
