Abstract

Rasgo distintivo del constitucionalismo moderno, la justicia constitucional ha atraído el interés de la doctrina jurídica de todo el mundo. Los autores de este volumen se proponen aportar una contribución original a través del método comparado, el instrumento epistemológico indispensable para el estudio del derecho constitucional contemporáneo, en cuanto capaz de superar los límites del positivismo jurídico y las barreras del etnocentrismo. El volumen propone una clasificación original, que combina la lógica dicotómica aristotélica y el método "fuzzy", para llegar a dos modelos -nomocrático y pantocrático- basados en la función predominante del control, con relación a la naturaleza del poder controlado. por esta vía, el control nomocrático se difumina en el pantocrático, y este último adquiere intensidad variable según el contexto jurídico, pero también político, social y cultural, en el que se manifiesta concretamente. El activismo de los jueces constitucionales, al que hoy se añade prepotentemente el de los tribunales supranacionales y transnacionales, ha atraído admiraciones y críticas. Los autores dedican también un amplio espacio al papel del "control de convencionalidad" en sus relaciones con la justicia constitucional "doméstica". Aunque son ontológicamente diferentes, ambas formas de control comparten el menos un elemento, a saber, la ausencia de legitimidad popular y, por tanto, un fuerte potencial desestabilizador de la dogmática constitucional clásica.
