Abstract

Patrimonio intangible, patrimonio inmaterial, diversidad cultural, identidad y memoria, patrimonio de la humanidad... son conceptos que evocan la construcción colectiva de la creación humana, que es propiedad de todos y que a todos debe revertir. Este discurso, liderado por UNESCO, choca frontalmente con la ideología capitalista global dominante estructurada sobre la propiedad privada, la propiedad intelectual y los derechos de autor. Para las organizaciones que hoy día imponen dicha ideología, la cultura, incluido el patrimonio cultural, o es un producto o es un servicio, en cualquier caso una mercancía, un objeto económico, algo con lo que se puede comerciar y obtener ganancias y sobre el que previamente hay que ejercer derechos de propiedad. Este artículo quiere llamar la atención sobre el proceso que se está llevando a cabo en el seno de la Organización Mundial de la Propiedad Intelectual (OMPI) con respecto a lo que denominan "conocimientos tradicionales y folclore" y la inclusión de estos, que hasta ahora habían sido considerados como un dominio público, no propietario y por tanto libre, en el "sistema de la propiedad intelectual" y sobre las graves consecuencias que para el futuro del patrimonio de la humanidad y de "nuestra diversidad creativa", tendría esta iniciativa.
