Abstract

Los avoiding powers tienen por objeto la rescisión de aquellos actos realizados por el deudor para impedir la efectiva satisfacción de los acreedores. El Derecho norteamericano contiene una tipología muy variada de estas facultades en contraposición con la acción de reintegración concursal del Derecho español, siendo muy interesante abordar el estudio de ambas categorías.

The avoiding powers are focused on the avoidance of those transactions made by the debtor in order to stop the payment to debtor s creditors. American Law has a wide range of these powers in comparison with the recovery action under Spanish Law and, therefore, it is very interesting to study both topics.
