Entorno familiar y cuidado alternativo

Abstract

En el presente capítulo, se aborda el análisis del sistema de protección de menores español a la luz de la CNUDN. Para ello, se parte del derecho de vivir y crecer en un entorno familiar libre de violencia, y de la estructura administrativa y competencial española en la materia, sobre la que el CRC ha hecho diversas observaciones. A continuación, se analizan las tres etapas por las que pasa un niño en relación con el sistema de protección: la entrada al mismo (con la guarda voluntaria, el riesgo y el desamparo), las medidas de protección aplicables (con el acogimiento residencial o familiar y la adopción nacional e internacional), y la salida del sistema (con el retorno a la familia de origen o la vida independiente).

This work is an analisys of ths spanish children protection system from the rights perspective of the CRC, specially the right of every child to a family life
