Abstract

Aun cuando han transcurrido más de quince años desde que el legislador habilitase a los Ayuntamientos para exigir un recargo de hasta el 50% de la cuota líquida del impuesto sobre bienes inmuebles cuando de inmuebles de uso residencial desocupados con carácter permanente se tratase, el imprescindible desarrollo reglamentario para definir qué inmuebles habían de entenderse como tales no se ha llegado a producir. Durante tal lapso temporal, fueron las distintas Salas de lo Contencioso-Administrativo de los Tribunales Superiores de Justicia las que han declarado que la potestad reglamentaria correspondía exclusivamente al Gobierno Central, mientras que el Tribunal Constitucional se ha encargado de avalar tanto la constitucionalidad del recargo concernido como la compatibilidad de éste con los impuestos autonómicos que han gravado la titularidad de las viviendas desocupadas o vacías. Paradójicamente, ha sido finalmente el propio Ejecutivo estatal el que, acudiendo a la figura del Decreto-ley, deriva a la normativa sectorial de vivienda, autonómica o estatal, y en todo caso con rango de ley, la concreción del concepto tan largamente esperado.

Even though more than fifteen years have elapsed since the legislator authorized the City Councils to demand a surcharge of up to 50% of the net amount of property tax when residential property is unoccupied on a permanent basis, the essential regulatory development to define what buildings had to be understood as such has not been produced. During that period of time, the different Contentious-Administrative Chambers of the Superior Courts of Justice have established that the regulatory power pertained exclusively to the Central Government, while the Constitutional Court has been in charge of endorsing both the constitutionality of the surcharge concerned as the compatibility of this with the regional taxes that have taxed the ownership of empty housing. Paradoxically, it has finally been the State Executive himself who, drawing on the figure of the Decree-Law, has derived to sectoral housing regulation, autonomic or state, and in any case with the status of law, the realization of the concept so long awaited.
