Los menores no acompañados y el derecho de asilo

Abstract

En este capítulo se examinan las características de un sistema de asilo que mejore el acceso de los menores extranjeros no acompañados a la protección internacional. Para ello es necesario proporcionar a las autoridades implicadas, intérpretes, abogados, etc., una formación específica tanto en temas de menores como de asilo. Los menores extranjeros no acompañados, al igual que los adultos, tienen derecho a buscar protección fuera de su país de origen. El derecho de asilo constituye para los menores no acompañados una nueva pieza en el complejo puzzle que supone su presencia en otro país. En este texto se pretende ofrecer un breve recorrido por los pasos que permiten a un menor no acompañado buscar asilo. Para llevarlo a cabo hay que tener en cuenta dos presupuestos básicos de la normativa española: la ausencia de un tratamiento diferenciado de los adultos para los menores y la necesidad de guiarse en todo momento por el principio del interés superior del menor.

This text deals with the particular situation of unaccompanied minors when they are asylum seekers. It is one of the most vulnerable groups since they are at increased risk of social exclusion. The article focus on the new 2009 Spanish Asylum Law because it has represented a qualitative leap with respect to the previous legislation. Differential treatment is required regarding unaccompanied minors and the principle of best interest of the child should be taken into account in each decision. The text analyses these issues in the Spanish context.
