Abstract

Este trabajo examina la idoneidad de la Filosofía del Derecho penal como disciplina para abordar el debate sobre la vinculación entre las posiciones fundamentales que se defienden en el ámbito de las disciplinas penales con una ideología o una filosofía política y moral. Así, se presentan sintéticamente los contenidos esenciales que podrían dar cuerpo a la filosofía del Derecho penal: la reflexión normativa sobre el fundamento del Derecho penal y su legitimación, así como la reflexión normativa sobre sus características formales y sobre los criterios de criminalización de conductas. Seguidamente, se exponen las líneas esenciales de dos de las posibles aproximaciones a este conjunto de cuestiones, que conectan con las principales líneas de pensamiento político y moral: el liberalismo y el comunitarismo.

This paper addresses the aptness of Philosophy of Criminal Law as the proper field to tackle the argument about the connections between Criminal Theory and Political and Moral Philosophy. Thus, the paper deals with the main subjects of Philosophy of Criminal Law: the normative deliberation about the foundation and legitimacy of Criminal Law, as well as the normative discussion about its formal characteristics and material content (criminalization theory). Subsequently, the paper analyses two of the most promising political and moral approaches to this set of questions: liberalism and communitarianism.
