Abstract

La aprobación del polémico Real Decreto-ley 16/2012 y la limitación al acceso a las prestaciones que respecto de los inmigrantes ilegales dicha norma supuso dio lugar a una nueva modalidad de objeción de conciencia inédita en nuestro sistema social: la ob- jeción de conciencia positiva. Así, diferentes faculta- tivos expresaron su negativa, al amparo de su libertad de conciencia, a cumplir con la prohibición de dar asistencia sanitaria gratuita a los citados inmigrantes, fuera de los casos previstos por la norma como ga- rantía del contenido esencial del derecho a la salud. En nuestro trabajo sostenemos que pese a que, con carácter general, no hay, al amparo de la doc- trina sobre la objeción de conciencia del Tribunal Constitucional, ningún obstáculo para admitir dicha modalidad de objeción, sí consideramos que por las circunstancias que concurren en el caso especí co planteado al amparo del Real Decreto-ley 16/2012 no cabe admitir la misma.

The approval of the controversial Royal Decree-Law 16/2012 and the limitation to access to benefits that illegal immigrants said said rule gave rise to a new modality of conscientious objection unprecedented in our social system: objection of positive conscience. Thus, different faculties expressed their refusal, under the protection of their freedom of conscience, to comply with the prohibition of giving free health care to the aforementioned immigrants, outside the cases provided by the norm as a guarantee of the essential content of the right to health. In our work we maintain that although, in general, there is no obstacle to admitting this modality of objection, under the doctrine on conscientious objection of the Constitutional Court, we do not consider that due to the circumstances in the case Specified under Royal Decree-Law 16/2012 can not be accepted.
