Abstract

This chapter deals with the minor as an offender and his / her passage through the criminal process. A critical and evaluative judgment is made of the initiation of the file and the main role of the Public Prosecutor whose action is informed basically of the principle of opportunity as well as the role of the judge during the process connected with the rights and obligations of minors and Its connection with restorative justice.

Este capítulo trata del menor como infractor y su paso por el proceso penal. Se hace un juicio crítico y valorativo de la iniciación del expediente y del papel principal del Ministerio Fiscal cuya actuación está informada básicamente del principio de oportunidad así como de la funcion del juez durante el proceso conectado con los derechos y obligaciones de los menores de edad y su conexion con la justicia restaurativa.
