La irreversibilidad del Estado social bajo el paradigma de la igualdad

Abstract

Entender que la igualdad efectiva es una exigencia y una condición sine qua non del Estado democrático, implica un cambio de prisma puesto que, de este modo, aquélla no está sujeta a la disponibilidad de los recursos y al reparto o recorte caprichoso del poder público y de la voluntad del legislador disfrazada de legitimidad democrática, oportunidad política y margen de discrecionalidad. Por el contrario, entendida como un principio democrático, únicamente se ve limitada por la progresividad en la implantación y consecución de la igualdad, pues se está ante un derecho fundamental a cuyo cumplimiento se encuentran vinculados los poderes públicos que parten de un Estado no neutral, sino implicado con los valores y principios que el artículo 1.1 CE enuncia como propios de este modelo de Estado. Desvincular la efectividad de la igualdad de su reconocimiento jurídico-formal conlleva a la desprotección de personas en situación de mayor vulnerabilidad. La igualdad, se presenta, por lo tanto, como un trascendente punto de partida y objetivo para propiciar el cambio de paradigma hacia un pacto que amplíe la protección de los derechos y dote a la Constitución de la ductilidad necesaria para albergar el sistema de garantías suficiente que haga efectivos todos los derechos constitucionalizados.

Understand that real equality is a demand and a sine qua non of a democratic state, it implies a change prism because, in this way, it is not subject to the availability of resources and the distribution or capricious cut public power and the will of the legislature disguised as democratic legitimacy, political expediency and discretion. On the contrary, understood as a democratic principle, only limited by the escalation in the implementation and achievement of equality, as it is facing a fundamental right to the fulfillment of which are linked public authorities that depart from a non-neutral state, but involved with the values ​​and principles that Article 1.1 EC states as belonging to this state model. Unlink the effectiveness of equality of its legal-formal recognition leads to the vulnerability of people most vulnerable. Equality arises, therefore, as an important starting point and goal to promote the paradigm shift towards a pact to extend the protection of the rights and dowry to the Constitution of the ductility necessary to accommodate the system guarantees sufficient to make effective all rights constitutionalized.
