Abstract

El desarrollo del trabajo permite evidenciar que el debate sobre la fuerza vinculante de la doctrina y la jurisprudencia Constitucional continúa y continuará vigente mientras el derecho se considere no como una disciplina estática sino como una ciencia en permanente cambio y evolución, que acepta hipótesis, teorías o hechos peligrosos para su integridad doctrinal y epistemológica, como la posibilidad de la discrecionalidad judicial o la aceptación de un efecto erga omnes de algunas sentencias.
