A critique of ethics regulation in Turkish public administration

Abstract

In today's world, ethics has become an important discussion topic in publicadministration. Through the effects of neo-liberalism as the dominant ideology ofglobalization, Turkish public administration has forced to change with structuralreforms by the international and regional organizations which are both ideologicallyand economically powerful on Turkey. The emergence of new forms of managementtechniques and governance models represented by the market values have triggeredthe moral transformation in Turkey. Thus, ethics regulation in Turkey has emergedas an external control mechanism since 2004 and focused on the desirable forms ofbehaviors of public administrators.By attributing a very different meaning to the concept, ethics in Turkey has beengrounded in extensive legalism almost substituting the law with its regulatorystructural model. Therefore, this thesis study has examined the ongoing processrelating to ethics regulation in two dimensions as legal/judicial andstructural/organizational and tried to set forth legal and structural deficiencies in theimplementation. Despite the fact that the concept of ethics is theoreticallyinappropriate to be a subject matter of the regulation, legalization andinstitutionalization of ethics in Turkey has led to discharge of its meaning byremoving it from its main function. The empirical study with the interviewsconducted with government officials within the scope of this thesis has emphasizedthat ethics regulation has emerged as a pointless effort since the very beginning inTurkey.Keywords: Ethics Regulation, Administrative Ethics, Ethics Management in Turkey

Bugün dünyada, etik, kamu yönetimi literatüründe tartışılan önemli bir konu halinegelmiştir. Küreselleşmenin baskın ideolojisi olan neo-liberalizmin etkileriyle, Türkkamu yönetimi ideolojik ve ekonomik olarak Türkiye üzerinde güçlü olanuluslararası ve bölgesel kuruluşlar tarafından yapısal reformlarla değişimezorlanmıştır. Yeni yönetim tekniklerinin ve yönetişim biçimlerinin kamuda ortayaçıkması Türk kamu yönetiminde de ahlaki dönüşümü tetiklemiştir. Böyle birçevrede, etik regülasyon dışsal bir denetim aracı olarak 2004 yılından itibaren ortayaçıkmış ve kamu yöneticilerinde istendik davranış biçimleri üzerine odaklanmıştır.Kavrama farklı anlamlar yüklenerek, Türkiye'de etik, düzenleyici yapısal modeli ileneredeyse hukuku ikame edecek şekilde yoğun bir kanunculuk iletemellendirilmiştir. Bu sebeple, bu tez çalışması etik regülasyona dair devam edensüreci yasal/yargısal ve yapısal/kurumsal olarak iki boyutta incelemiş veuygulamadaki eksiklikleri ortaya koymaya çalışmıştır. Etik kavramı teorik olarakdüzenleme konusu olmaya uygun olmamasına rağmen, etiğin hukuklaştırılması vekurumsallaştırılması kamu yönetiminin temel fonksiyonundan uzaklaşmasına ve etikkavramın içeriğinin boşaltılmasına neden olmuştur. Bu tez çalışmasında yapılanampirik çalışma kapsamında kamu görevlileri ile yapılan röportajlarda, Türkiye'dekietik regülasyonun en başından beri verimsiz bir çaba olarak ortaya çıktığıvurgulanmıştır.Anahtar Kelimeler: Etik Düzenleme, Yönetim Etiği, Türkiye'de Etik Yönetim
