Abstract

In the writing of the usul al-fiqh it is known that there are two methods: fuqaha and mutakallimin. The first method is generally used by Hanafi scholars and the second method is used by the scholars of the other three sectarians. Besides, the mamzuc method (the tariqah al-cem`), which consisted of a mixture of two methods, emerged in the late periods. It is known that there are two schools within the Hanafi sectarian, which adopts the fuqaha method, namely schools of Iraq and schools of Samarqand. Karkhi and his student Jassas one of the leaders of the Iraq school; It is possible to mention Maturidi and Alauddin al-Samarqandi, who are among the leaders of the Samarqand school. In our study, the subject of abrogation (naskh), which has been discussed since the first centuries in a comparative way between the two schools in question. The fact that the works of some scholars of the two schools do not reach until today and the difficulty of researching the thoughts of scholars in a thesis has led us to the narrow the subject of the study. The works of Karkhi and Maturidi on the method of fiqh do not reach until today and the views of these two scholars were mostly transmitted to us from Jassas and Samarqandi, who followed their own lines, our study has been handled in the context of Jassas and Samarqandi. Discussions about the nature, meaning, conditions of abrogation and which provisions are abrogated or not in practice have been up to date since the first centuries. In this study, which is based on Jassas's al-Fu?ûl fî al-u?ûl and Semerqandi's Mizan al- usul fi nata 'ij al-'Uqul it has been studied to determine the similar and divergent points in the thoughts and methods of the concepts of abrogation between the two scholars.

Fıkıh usulü telifinde fukahâ ve mütekellimîn olmak üzere iki metodun olduğu, genelde ilk metodu Hanefî âlimleri, ikinci metodu ise diğer üç mezhep âlimlerinin kullandığı bilinmektedir. Bunun yanında sonraki dönemlerde iki metodun karışımından ibaret olan memzûc metot ortaya çıkmıştır. Fukahâ metodunu benimseyen Hanefî mezhebinin bünyesinde Irak ve Semerkant ekolü olmak üzere iki ekolün bulunduğu bilinmektedir. Irak ekolü önderlerinden Kerhî ve öğrencisi Cessâs; Semerkant ekolü önderlerinden ise Mâtürîdî ile Alâüddîn Semerkandî'yi zikretmek mümkündür. Çalışmamızda ilk asırlardan itibaren tartışma konusu olan nesih konusunu söz konusu iki ekol arasında mukayeseli bir şekilde ele alınmıştır. İki ekolün bazı âlimlerinin eserlerinin günümüze ulaşmaması ve iki ekolün âlimlerinin düşüncelerinin bir teze sığdırılmasının zorluğu yapacağımız çalışmanın konusunun daraltılmasını gerektirmiştir. Kerhî ile Mâtürîdî'nin fıkıh usulüne dair eserlerinin günümüze ulaşmaması ve bu iki âlimin görüşlerinin büyük oranda kendilerinin çizgilerinde yol alan Cessâs ile Semerkandî'den bize nakledildiğinden, çalışmamız, Cessâs ile Semerkandî özelinde ele alınmıştır. Neshin mahiyeti, anlamı, şartları ve pratikte hangi hükümlerin nesh olup olmadığı tartışmaları ilk asırlardan beri güncelliğini korumaktadır. Genel olarak Cessâs'ın el- Fu?ûl fi'l-u?ûl eseri ile Semerkandî'nin Mîzânü'l-u?ûl fî netâ?ici'l-?u?ul eserinin esas alındığı bu çalışmada, her iki âlimin nesih konusundaki yaklaşımları, konu bağlamında teorik açıdan benzeşen ve ayrışan noktalar tespit edilemeye ve değerlendirilmeye çalışılmıştır.
