Abstract

Dünya medeniyetinin beşiği olan Mezopotamya, aynı zamanda ilk yazılı hukuk kuralarının oluşturulduğu bölge özelliğini taşımaktadır. Mezopotamya'nın yazılı hukuk metinleri incelendiğinde, burada oluşan siyasi erklerin geniş halk kitlelerini itaat altında barındırabilmek ve hükmetmek amacıyla toplum tabanında bulunan "dinî kuralları" siyasi bakış açısıyla harmanlayarak hukuk maddelerini tanzim ettikleri anlaşılmaktadır. Böyle bir süreçte, iktidar sahiplerinin beslendiği meşruiyet kaynakları da yine dinseldir ve teokratik devlet nizamı hâkimdir. Bununla birlikte ilk defa Sumerler tarafından kurulan söz konusu devlet yapısında, Güneş Tanrısı dUTU adaletin koruyucusu olarak kabul edilmiştir. Nitekim Ur-Nammu'nun kanun metninde dUTU adaletin koruyucu tanrısı olarak öne çıkmaktadır. Ayrıca Mezopotamya'nın Sami asıllı kanunları olan ana-İtuşu, Lipit-İ?tar, E?nunna ve Hammurabi Kanunları ile Orta Asur Kanunları'nın prologue ve epilogue kısımları ile çeşitli kanun maddelerinde tanrı ve din etkisini görmek mümkündür
