Abstract

Kamu yönetimi sistemi devletin sevk ve idaresinde anahtar rol oynayan en önemli mekanizmadır. Kamu bürokrasisinin sağlıklı işleyebilmesi için zamanın koşullarına adapte olabilen iyi bir personel rejimine ihtiyacı vardır. Bugün başta Avrupa olmak üzere pek çok ülke geçmişte yaşadıkları tevrübelerden ders çıkararak kendi kamu yönetimi sistemlerini kayırmacılıktan liyakata yönelik tamamen objektif kriterlere göre yönetme yolunda mesafeler almışlardır. Türkiye ise Osmanlı İmparatorluğu mirasına dayanan kamu personel rejimi temelinde ilerlemesine devam etmektedir. Geçmişte yaşamış olduğu ve genellikle siyasi partilerin müdahalesi ışığında tecrübe edilen kamu personel yönetimi kayırmacılığın etkisinin çok fazla görüldüğü bir yapı arz etmekteydi. Ancak liyakate dayanmadan istihdam edilen kişilerin kamu yönetiminde yer bulmaları kamu hizmetinde ciddi aksaklıklara neden olması bir takım tedbirlere başvurma ihtiyacını getirmiştir. Bunun içinde çeşitli yasalar çıkartılarak kayırmacılığın önüne geçilmek istenmiştir. Bugün liyakat bağlamında önemli mesafeler alan Türk Kamu Yönetim sistemi halen varmak istediği hedeflerin uzağında olmasına rağmen Avrupa Birliği kriteleri bağlamında ilerlemesine devam etmektedir. Bu ilerlemedeki en büyük engel kayırmacılığa neden olan istisnai memurluk kadroları görülmektedir. İyi bir kamu yönetimi için yapılaması gereken şey anayasa ve personel kanunlarında yer alan liyakat ilkesinin uygulamada da görülmesi ve bu amaca matuf olarak bir Liyakat Koruma Kurulunun oluşturulmasıdır. Çalışma çeşitli ülkelerin kayırmacılıktan liyakata yönelik tecrübelerini orataya koyarken Türk kamu yönetim sisteminin tarihsel sürecine ışık tutmayı amaçlamaktadır.

Public administration system is the most significant mechanism that plays a key role in the management of the state. For a healthy functioning of the public bureaucracy, a sound personnel regime which can be adapted to the conditions of the regime is needed. Today, most countries especially in Europe have succeeded a sercious breakaway from nepotism to merit-based systems, but Turkey continues to progress on the basis of public personnel regime which is inherited from the Ottoman Empire. In the light of the experience in the past, nepotism has had considerable impact on public administration system due to the political parties. However, public servants who are not employed on the basis of merit in the public administration to cause serious problems, which brought about the need for resorting to some measures. In order to prevent nepotism, various laws have been enacted. Today, in the context of merit, Turkish public management system has taken a serious path but it is still a long way from the point that it desires; yet, Turkey wants to reach the targets in the context of European Union criteria. The ultimate obstacle in this path is the exceptional public servant cadres seen in public administration. What is needed to develop a sound public administration system is to put into practice the meritocracy principles that are only on paper and to establish a Merit Protection Board for this purpose. This study aims to shed light on the historical process of the Turkish public administration system while giving the experiences of various countries from nepotisim to merit.
