Abstract

Within the context of Ottoman history, numerous works have been authored in the field of Islamic law, with some of them fully accessible to us while others have reached us in incomplete form due to various reasons. These endeavors were particularly prominent during the 16th and 17th centuries. Among the scholars who lived during this period and made significant contributions to jurisprudential matters was Ali Cemâlî, known as Zenbilli Ali Efendi, a jurist from Karaman. Serving as the Shaykh al-Islam during the reigns of Sultan Bayezid II, Selim I (Yavuz Sultan Selim), and Suleiman I (Kanuni Sultan Suleiman), he made contributions to nearly every field of Islamic sciences. Before commencing this study, the initial stage involved a comprehensive review of classical jurisprudential texts and library archives. Subsequently, existing studies on the subject matter were examined, and reference was made to the author's own work. The topics of transactions (muamalat) covered in Zembilli's work formed the basis of this thesis. The author, in issuing his legal opinions (fatwas), adhered to the principles of the Hanafi school of jurisprudence while also mentioning the views of Imam Shafi'i thereafter. His comprehensive coverage of all matters pertaining to transactions is noteworthy. The absence of any completed study on Zenbilli prompted the undertaking of this thesis. In this study, information is provided regarding Zenbilli Ali Efendi's life, family, the religious, political, and economic characteristics of his era, his scholarly personality, and his legal opinions on transactions, alongside comparisons with classical jurisprudential texts. Through research, it becomes evident that Zembilli, influenced by Merginani's work "al-Hidaya," composed his own work titled "Muhtaratu'l-Hidaye," thereby remaining within the Hanafi tradition. The study concludes with a general evaluation, including references to the opinions of Hanafi imams and Imam Shafi'i, which Zenbilli did not favor. Osmanlı döneminde İslâm hukuku alanında pek çok eser kaleme alınmıştır. XVI. ve XVII. Yüzyıllarda yoğun olarak ortaya çıkan bu çalışmalardan bazıları günümüze tam bir şekilde bazıları ise farklı sebeplerle eksik ulaşmıştır. Söz konusu dönemde yaşamış ve fıkhî meselelerde önemli konulara imzasını atmış âlimlerden biri de Karamanlı fakih, Zenbilli Ali Efendi diye bilinen Ali Cemâlî'dir. Fatih döneminde doğup II. Bayezid, Yavuz Sultan Selim ve Kanuni Sultan Süleyman döneminde şeyhülislâm olarak görev yapan Zenbilli Ali Efendi en önemlisi İslâm hukuk alanında olmak üzere İslâmî ilimlerin neredeyse her alanına katkı sağlamıştır. Elimizdeki tezin yazılması için klasik fıkıh kitapları ve kütüphane arşivleri elden geçirilmiştir. Ayrıca konuyla ilgili yapılan çalışmalar incelenmiş ve müellifin kendi eserine müracaat edilmiştir. Zenbilli'nin kitabında yer verdiği muamelat konuları tezin konusunu oluşturmuştur. Müellif, fetvalarını verirken Hanefî fıkhının esaslarını dikkate almış ve bazı konularda İmam Şafiî'nin görüşlerini akabinde zikretmiştir. Meselelere yaklaşımındaki tavrı yanında muâmelât alanına dair bütün konulara değinmiş olması önemlidir. Yapılan incelemelerde Zenbilli hakkında bitmiş bir çalışmaya rastlanmamış olması böyle bir tez hazırlanmasına teşvik etmiştir. Çalışmada Zenbilli Ali Efendi'nin hayatı, ailesi, yaşadığı dönemin dînî, siyasi, ekonomik özellikleri, ilmi kişiliği yanında muamelata dair fetvaları hakkında bilgi verilirken klasik fıkıh kitaplarıyla karşılaştırılmalar da yapılmıştır. Araştırmalar neticesinde Merginânî'nin el-Hidâye adlı eserinden etkilenerek Muhtaratu'l-Hidâye adlı eserini oluşturduğu anlaşılan Zenbilli'nin Hanefî gelenekten ayrılmadığı görülmüştür. Çalışmanın sonunda Zenbilli'nin tercih etmediği Hanefî imamların ve ve diğer mezheplerde yer alan konuyla ilgili görüşler zikredilerek genel bir değerlendirme yapılmıştır.
