Abstract

The rule of law enableing the individual in safe against the state has appeared afterthe concept of the property state and the police state in the historical developmentprocess. The primary principles of the rule of law may be listed as to limit theauthority of the state, to protect the fundamental rights, the independency ofjudiciary, judicial examination, equity before the law and the seperation of powers.The judicial examination of laws whether they are in compatible with theconstitution has a great importance to realize the rule of law and to improve theprinciples of rule of law. The point of view of the Constitutional Court to the rule oflaw, its interpretation of the concept, to protect the rule of law and in this context towhat extent it is successful to protect and to improve the individual freedoms andhuman rights and what contributions the Court makes are the matters which consistof the purpose of this study in the light of the judgments of the Constitutional Court.In the first part of the study the rule of law has been dealt with in conceptialframework, having touched upon the historical development process, the relationshipbetween the Constitutional procedure has been dwelled upon. The first part has beenfinished with the study of the requirements of rule of law. In the second part thecontributions of Constitutinal Court to the concept and the principles of the rule oflaw have been put forward by examining the judgments of the Constitutional Court.The concept of rule of law and the Constitutional Court was introduced for the firsttime in our country with 1961 Constitution and these two concepts sustained theirexistence with 1982 Constitution. In this process the Constitutional Court has madesubstantial contributions with its judgments to the Turkish judiciary and democracyby being painstaking on the issue of protecting and improving the human rights andfreedoms which is an important principle of the rule of law.

Bireyin kendini devlete karşıgüven içinde hissedebilmesini sağlayan hukukdevleti, tarihsel gelişim seyri içinde, mülk devleti ve polis devleti anlayışınınardından ortaya çıkmıştır. Devlet otoritesinin sınırlandırılması, temel hak vehürriyetlerin güvence altına alınması, yargıbağımsızlığı, yargıdenetimi, yasaönünde eşitlik ve kuvvetler ayrılığıhukuk devletinin belli başlıilkeleri olaraksayılabilir.Yasaların anayasaya uygunluğunun yargısal denetimi hukuk devletinin yaşamageçirilmesi ve ilkelerinin geliştirilmesinde önemli bir yere sahiptir. AnayasaMahkemesi'nin hukuk devleti ilkesine bakışaçısı, bu kavramıyorumlayışı, hukukdevletini ve bu bağlamda kişi özgürlükleri ile insan haklarınıkorumada vegeliştirmede ne ölçüde başarılıolduğu ve bu alanda ne gibi katkılar sağladığıhususlarında Anayasa Mahkemesi Kararlarıışığında değerlendirilmesi çalışmanınamacınıoluşturmaktadır.Çalışmanın ilk bölümünde hukuk devleti kavramsal çerçevede ele alınmış, tarihselgelişim sürecine değinildikten sonra anayasa yargısıile ilişkisi incelenmiştir.Hukuk devletinin gereklerinin incelenmesi ile ilk bölüm bitirilmiştir. İkincibölümde ise Anayasa Mahkemesinin kararlarıüzerinde incelemeler yapılarakMahkemenin hukuk devleti anlayışıve hukuk devletine katkısıortaya konulmayaçalışılmıştır.Hukuk devleti kavramıve Anayasa Mahkemesi, ülkemizde ilk kez 1961Anayasasıile düzenlenmişve 1982 Anayasasında da varlığınıdevam ettirmiştir.Bu süreçte Anayasa Mahkemesi vermişolduğu kararlar ile hukuk devleti ve hukukdevletinin önemli bir ilkesi olan insan haklarıve özgürlüklerini koruma vegeliştirme hususunda hassas davranarak Türk hukuk ve demokrasi hayatına önemlikatkılarıolmuştur.
