Abstract

The present study, titled as `Concerted Practices in Competition Law`, consists of an exhaustive analysis on Competition Law, which has recently emerged as an innovative branch of our judicial system. The study also refers to the foundational goals and contents of the Act on the Protection of Competition, No. 4054. In this context, a special reference has been devoted to the evaluation of `concerted practices` – which exist with the 4th article, called `Restrictive, Agreed, and Concerted Practices and Resolutions on Competition`, under the larger group of `Prohibited Acts` – in line with the verdicts taken by the Turkish Competition Board.The study puts remarkable emphasis on the Concerted Practices on grounds that concerted practices are usually performed secretly and thus lead to restricted competitions, these practices are frequently updated by court verdicts, some prominent Turkish banks have been investigated over the allegations of concerted practices, and it is needed to assess what acts are regarded as concerted practices.Through this study, we aimed to develop a new approach to how these practices are performed and what elements they consist of, by utilising the relevant studies and the verdicts taken by the Turkish Competition Board. Further, the study includes a comparison between the concepts of 'agreed' and 'concerted' – considering that these terms are easily confusable – and also tries to come up with a different point of view into proving a concerted practice and into the notion of proving liability.

`Rekabet Hukukunda Uyumlu Eylemler` tezimizde hukuk sistemimiz içerisinde gelişmeye açık ve yeni bir dal olan Rekabet Hukuku üzerinde öncelikle durulmaya çalışılmıştır. Rekabetin korunmasını ve geliştirilmesini amaç edinen 4054 sayılı Rekabetin Korunması Hakkında Kanun hazırlanış amacı ve içeriği üzerinde durulmuştur. Özellikle kanun içerinde `Yasaklanan Faaliyetler` başlığı altındaki 4. Madde kapsamında `Rekabeti Sınırlayıcı Anlaşma, Uyumlu Eylem ve Kararlar` içerisinde bulunan `Uyumlu Eylem` kavramı Rekabet Kurulunun vermiş olduğu kararlar da incelenerek açıklanmaya çalışılmıştır. Genellikle uyumlu eylemlerin gizli bir şekilde yapılarak rekabetin kısıtlanması, konunu; özellikle mahkeme kararlarıyla sürekli gelişen ve güncelliğini koruyan bir yapıda olması, özellikle son günlerde ülkemizin önde gelen bazı bankaların uyumlu eylemlerden dolayı soruşturma geçirmeleri, teşebbüsler arası işbirliklerinin hangi hallerde uyumlu eylem olarak değerlendirileceği hususu `Rekabet Hukukunda Uyumlu Eylemler` konusunu seçmemizde etkili oldu. Uyumlu Eylemlerin nasıl gerçekleştiği ve genel olarak unsurlarının neler olduğu üzerinde yine literatür ve Kurul'un vermiş olduğu kararlardan yararlanılarak bir yaklaşım geliştirilmeye çalıştık. Yakın kavramlar olması münasebetiyle Anlaşma ve Uyumlu eylemler arasındaki farklar ortaya konulmuş, son olarak ise Uyumlu Eylemin ispatının nasıl yapılacağı ve ispat yükümlülüğü üzerinde durularak konuya farklı bir bakış açısı geliştirmeye çalıştık.
