Küçük ve orta büyüklükteki işletmelerin küreselleşen dünya ekonomisinde artı bir güç olarak varlıklarını devam ettirebilmelerinin en önemli şartlarından birisi, bu işletmelerin serbest piyasa koşullarında rekabet güçlerini artırabilecekleri ve üretim kabiliyetlerinin temeli olarak görülen girişimcilik ruhlarını geliştirebilecekleri uygun bir iş ortamının sağlanmasıdır. Bu hedefe giden ve coğrafi anlamda sınır tanımayan küresel ticaret yolunun parke taşlarını, ülkeden ülkeye farklılık göstermeyen ve böylelikle, yol üzerinde hareket eden işletmelere sahip oldukları hakları, ölçek, sektör, yasal statü ve tabiiyetleri ne olursa olsun elde edebilecekleri konusunda güven veren basit ve devletler üstü yeknesak hukuk kurallarının oluşturacağı açıktır. Bu çerçevede Avrupa Birliği’nce, üye devletlerce doğrudan uygulanacak veya uyum sağlanacak zorunlu düzenlemeler getirilmiş olmakla beraber, hukuk uygulaması anlamında, parke taşlarını kırma ve gevşetmeye yönelik teşebbüsleri engelleyecek ve böyle bir teşebbüsün varlığı halinde yaptırımlar uygulayacak bir denetim mekanizmasına ihtiyaç vardır. Her ne kadar, uluslararası ticari faaliyetlerde ortaya çıkabilecek uyuşmazlıkların giderilmesi için görev yapan tahkim kurumları mevcut ise de, tahkim prosedürünün özellikle küçük ve orta büyüklükteki işletmeler açısından getirdiği büyük mali külfet göz önüne alındığında, milletlerarası tahkim müessesesinin, küçük ve orta büyüklükteki işletmelere hukuki bir güvence vermekten uzak olduğu görülecektir. In a globalizing world economy, one of the most important conditions for the small and medium-sized enterprises to maintain their presence as a force for positive that providing suitable business environment for these enterprises to increase their competitiveness in the free market conditions and develop the entrepreneurial spirit as the basis of production capabilities. Obviously, the rule of law, which isn’t differ from country to country, and thus, making confidence the moving enterprises on this road to obtain their rights, regardless of the scale, sector, legal status and nationalities and which is a simple, multinational and uniform, will constitute the cobblestones of this goal and the geographically boundless global trade route. In this context, although mandatory regulations issued by the EU to be provided directly to apply or adjust, in legal practice, a control mechanism, which block attempts to break or loosen the cobblestones and apply sanctions in the presence of such attempts, is needed. Despite the presence of the arbitral tribunal, which work to eliminate conflicts in international commercial activities, considering the huge financial burden of the arbitration procedure for the small and medium-sized enterprises, it will be seen that the international tribunal can’t provide a legal assurance for the small and medium-sized enterprises. At this point a new institution insists itself: European Trade Court
