Abstract

II ABSTRACT In my work entitled `The System for the Closure of Political Parties,` I gathered six different subject headings into one study. On the first section, I touched upon the brith and maturing of political reason for this is the establishment of Turkey's foundational political and legal system was based upon western models. In the next chapter, I examined the closure political parties from the perspective of adherents of both liberal and non-liberal democracies. In the third section howewer, O I examined the closure of political parties from the perspective of the constitution and related legal codes o the Turkish Republic. In the fourth chapter, I dealt with the issue of which legal entity in Turkey Possesses the authority the close political parties. In addition, overall functions of the Constitutional Court were dealt with in this section. In the fifth chapter, two topics were analyzed. The first concerned variorus possible results that could arise from the closure of a political party in Turkey, then, these potenitial results were compared with those of Federal Germany's. In the sixth chapter, I analyzed a number of exemples in history of political parties that have been closer by Turkey's Constitutional Court as well as the reason for their closure. In the final concluding chapter, I made the important point that in general, the closure of political parties is not practiced ammongt western democratic countries and made the recommendation that too should avoid this practice.

ÖZET `Siyasi parti kapatma rejimi` isimli çalışmamı altı konu başlığı altında topladım. Birinci konu başlığı altında batı demokrasilerinde siyasi partilerin doğuşu ve gelişimi ile siyasi partilerin işlevleri üzerinde genel hatlarıyla durdum. Bunun sebebi, Türkiye'nin temel siyasi ve hukuki kurumlarının batılı örneklerine uydurulmaya çalışılmış olmasıdır. Bunu takip eden bölümde liberal demokrasi ve mücadeleci demokrasileri açısından siyasi partilerin kapatılmasını inceledim. `Türkiyede siyasi partilerin yasaklanması rejimi` başlığı altında ise T.C. Anayasasında ve siyasi partiler kanununda zikredilen kapatma nedenlerini ele aldım. Dördüncü başlıkta, kapatma davalarında yetkili organ olan ve günümüze kadar konumu ve yetkileri çokça tartışılan Anayasa Mahkemesi üzerinde özellikle durdum. Beşinci bölümde kapatma kararının nitelikleri ve sonuçlan üzerinde Federal Almanya' daki uygulamalarla karşılaştırma yaptım. Altıncı bölümde günümüze kadar Anayasa Mahkemesi tarafından kapatılan siyasi partilerden bir kısmını ele alıp kapatılma gerekçeleri üzerinde durdum. Sonuç bölümünde ise siyasi parti kapatmaya çağdaş dünyada rastlanmadığını, uygar dünyanın özgürlükçü demokrasiyi benimsediğini, ülkemizde de ibrenin bu yöne dönmesi gerektiğini savundum.
