Abstract

From the second hijri century onwards, several differences of opinion began to emerge systematically between fuqaha and this situation prepared the basis for the emergence of sects with an institutional structure. In the history of Islamic law, a variety of sects have emerged and some still exist while some do not. Throughout the history, Fuqaha have followed a certain sect. However, from time to time some fuqaha changed the sect they followed. Here, our thesis deals with the change of sect of fuqaha as a historical fact. The reasons and results of the sectarian change of fuqaha, the transition between sects, the differences of ideas and opinions of fuqaha after changing sect are discussed in this thesis.Key WordsFiqh, History of Islamic Law, Sect, Changing of sect, Fuqaha's changing of sect

Hicri II. yy.dan itibaren fukaha arasında çeşitli görüş ayrılıkları sistemli bir şekilde ortaya çıkmaya başlamış, bu durum mezheplerin kurumsal bir yapıyla ortaya çıkmalarına zemin hazırlamıştır. İslam hukuk tarihinde günümüze intikal eden ve etmeyen çeşitli mezhepler ortaya çıkmıştır. Tarih boyunca fukaha belirli bir mezhebe tabi olmuştur. Ancak fukaha arasında zaman zaman bağlı olduğu mezhebi bırakıp, bir başka mezhebe geçme durumu da yaşanmıştır. İşte tezimiz, tarihsel bir olgu olarak fukahanın mezhep değiştirmesini ele almaktadır. Fukahanın mezhep değiştirmesinin sebep ve sonuçları, tarih boyunca en çok hangi mezhebe geçiş olduğu, mezhep değiştirme sonrası fukahanın görüş ve düşüncelerinde değişiklikler tezde ele alınan konulardandır.
