Türk ceza yargılamasında 26.09.2004 tarihinde kabul edilen 5235 sayılı AdliYargı ?lk Derece Mahkemeleri ile Bölge Adliye Mahkemelerinin Kurulus, Görev veYetkileri Hakkında Kanun ve 5271 sayılı Ceza Muhakemesi Kanununun kabul edilmesiile istinaf bir kanun yolu olarak öngörülmüstür. Yüksek lisans tezi niteliğindeki bubilimsel çalısmamızda, Türk ceza yargılamasında kabul edilen ancak uygulamasıertelenen istinaf kanun yolu açıklanmıstır.Çalısma, üç bölümden olusmaktadır. Birinci bölümde; istinafın tanımı yapılarak,hukuki niteliği, amacı, çesitleri, tarihsel gelisimi, leh ve aleyhine ileri sürülen görüsleraçıklanmıstır. ?kinci bölümde; istinafın konusu, istinafa basvurmanın etkileri, istinafabasvurabilme sartları, istinaf nedenleri ve istinaf yargılaması açıklanmıstır. Üçüncübölümde ise; istinaf yargılaması sonrasında basvurulabilecek muhtemel kanunyollarından temyiz ve yargılamanın yenilenmesi açıklanmıstır.
Appeal is regulated as a remedy with the application of the code 5235 Nr.Construction, Jurisdiction and Competence of Courts of First Instance of GeneralJudgement of Justice and Circuit Courts of Appeal, passed into law on 26.09.2004( Code of Judiciary) and 5271 Nr. Criminal Procedure Code in Turkish PenalJudgement. In this master thesis remedy of appeal which is accepted in Turkishpenal judgement but the inure is postponed is studied.The study consist of three chapters. In the first chapter; definition, judicialcharacter, purpose, varieties, diachronic, favourable and infavourable opinions ofappeal is explained. In the second chapter; subject matter of the appeal, effects ofappeal, essentials of appeal, reasons and apellate judgement is explained. In thethird chapter; appeal in cassation and motion for new trial, probable processes oflaw may be applied after the judgement of appeal, are explained.
