Abstract

4721 sayılı TMK. m. 539-541 arasında düzenlenen ve şekli anlamda bir ölüme bağlı tasarruf türü olan sözlü vasiyetname; el yazılı ve sözlü vasiyetname düzenlenmesine engel, olağanüstü durumlar içinde olan mirasbırakanın başvurabileceği bir yoldur. Ölüme bağlı tasarruf, kişinin ölümünden sonra malvarlığına ne olacağını belirlemesine olanak veren bir hukuki işlem türüdür. Sözlü vasiyetnameyi el yazılı ve resmi vasiyetname şekillerinden ayıran en önemli özellik, bu türe sadece her iki türde de vasiyetname yapma imkanından mahrum olan kişilerin başvurabilecek olmasıdır. Sözlü vasiyetnamenin bu özelliği bile tek başına onun önemini açıklar mahiyettedir. Çünkü Kanun koyucu bu yolla son anlarını yaşayan kişiye, olağanüstü şartlar altında da olsa terekesinin kaderini belirleme imkanı vermekte ve onun arzularına verdiği değeri göstermektedir.

Nuncupative will (oral will), which is a term that regulated under the numbered 4721 Turkish Civil Code, Art. 539-541, is a kind of testemantery desposition that can be only used under the extraordinary situations which prevent the testator from using handwriting and formal forms of will. Testamentary disposition gives the testator the authority to decide future of his/her estate. Giving the chance of having a nuncupative will to the testator, who has no possibility to form a handwriting or formal will because of the extraordinary situations that he/she is under, is the main point of the nuncupative will. By the way, the legislator body's giving the chance to form a nuncupative will to the testator, shows the how respectfull it is to the last requests of him/her.
