Abstract

Geleneksel erkler dengesi sistemi, modern partiler devletinde fonksiyon yeteneğini kaybetmiştir. Erklerin ayrılması, denetiminin sağlanması ve bu denge sisteminin eski etki gücünü kazanabilmesi için yeni faktörlere ihtiyaç vardır. Bir denetim organı olarak Anayasa Yargısı burada devreye girer. Anayasa Mahkemesinin kurumsallaştırılması, daha çok “hukuk devleti” idealinden ve “erkler ayrılığı” ile iktidarın dengelenmesi isteğinden kaynaklanmaktadır. Bununla birlikte parlamentonun üstünlüğünün dengelenmesi için sadece hukuk devleti düşüncesi yeterli görülmemiş, Anayasa Yargısının gerçek meşruluğunu, Anayasanın üstünlüğünden aldığı anlayışı ağırlık kazanmıştır. Anayasa Yargısı sadece ve daima hukuk normlarının olmadığı veya Anayasa Yargısının kendi yorumuna göre Anayasanın siyasal organlara takdir hakkı tanıdığı yerde son bulur. İşte bu nokta Anayasa yargısının fonksiyonel ve mantıksal sınırıdır.
