Abstract

Bu yazının amacı Anayasa Mahkememizin cezalı tarhiyata karşı açılan davanın reddi nede-niyle mülkiyet hakkının ihlal edildiği iddiasının kabul edilmesi kararının incelenmesidir. Yüce Mahkeme ihlal hükmüne ek olarak ihlalin tespiti ile yetinmemiş ve sonuçlarının ortadan kaldırılması için yeniden yargılama yapılmasında hukuki yarar olmadığına ve başvurucudan tahsil edilen vergi ve cezanın kendisine faizi ile birlikte iade edilmesine de oybirliği ile karar vermiş bulunmaktadır. Karar incelemesi sonucunda somut olayda Yüce Mahkemenin mülkiyet hakkı ihlalini verginin yasallık ilkesine bağlamıştır. Anayasa Mahkememizin ihlal kararını vergi hukukumuzun soyut tip ve tipikleştirme olarak tanımlanan niteleme ve yoruma dayan-dırdığının savunulması oldukça güç görünmektedir. Mülkiyet hakkı ihlalinin; Danıştay kara-rındaki muhalefet şerhlerine, bağlayıcı olmayan yargı kararları ile bir muktezaya bağlanması ve kararda doktrine hiç müracaat edilmemesi, AİHM ihlal karar örneklerinde kullanılmayan yasallık ilkesine bağlanması da yoruma açıktır.

The aim of this paper is to examine Turkish Supreme Court ruling on violation of property right through levying tax & penalty charges on the case dismissed by Tax Judiciary. The Court not only ruled the case of violation but also forced the Turkish Ministry of Finance to refund the tax and penalty charges with interest to the party involved in tax case. After the examination of the ruling of Supreme Court it is observed that the decision is irrele-vant in accordance with the legal interpretation of the law with regard the case concerned. It is not proven the case held in the tax judiciary ruling is against legality principle of taxation so to cause the violation of property right. Court ruling is not consistent with the European Court of Human Rights practice and conflicting with the rulings.
