Türk hukukunda yasal grevin greve katılmayan ve greve katılamayan işçiler açısından sonuçları

Abstract

Bir işyerinde grevin başlaması durumunda, bu işyerinde çalışan tüm işçiler, sendikalı olsunlar veya olmasınlar, greve katılma veya katılmama konusunda tam bir özgürlüğe sahiptir. Sendikaların üyelerini greve katılmaya zorlama gücü yoktur. Olsa olsa üyelerine kendi tüzüğünde yazılı olan yaptırımları uygulayabilir. Bu durumda sendika üyesi olsun veya olmasın bazı işçiler greve katılmayabilir veya grevden vazgeçebilir. İşveren ise greve katılmayan veya katılmaktan vazgeçen işçileri çalıştırıp çalıştırmamakta serbesttir (m. 38/II).
