Abstract

La presente investigación tiene como objetivo determinar cómo se viene vulnerando el derecho de propiedad comunal reconocido en el Convenio 169 de la Organización Internacional del Trabajo (OIT) en las comunidades nativas del distrito de Chazuta, provincia y región de San Martín. Su estudio, análisis y desarrollo, se realizó bajo la mística de un enfoque cuantitativo, de tipo básico, a nivel descriptivo simple, de un diseño no experimental; donde la muestra de estudio estuvo conformada por 15 comuneros de cada comunidad nativa (Mushukllacta de Chipaota, Shilcayo, Canayo y Llucanayacu) que sumados hacen un total de 60, a quienes nos dirigimos con un cuestionario , la misma que se elaboró mediante preguntas abiertas tomando como consideración los indicadores y dimensiones de las variables en estudio, todo ello con la finalidad de conocer las percepciones, opiniones o atributos de elementos o factores que conforman una investigación. Los resultados mostraron que el derecho de propiedad comunal en las comunidades nativas del distrito de Chazuta viene siendo vulnerado constantemente por la no delimitación, demarcación y titulación de sus tierras y por los procesos de ocupación a través de las concesiones otorgadas por el mismo estado.

The aim of the present research is to determine how the right to communal property recognized in Convention 169 of the International Labor Organization (ILO) is being violated in the native communities of the district of Chazuta, province and region of San Martín. Its study, analysis and development, was carried out under a quantitative approach, of a basic type, at a simple descriptive level, of a non-experimental design; The study sample was made up of 15 community members from each native community (Mushukllacta of Chipaota, Shilcayo, Canayo and Llucanayacu), making a total of 60, to whom a questionnaire was addressed, which was elaborated through open questions, taking into consideration the indicators and dimensions of the studied variables, all with the purpose of understanding the perceptions, opinions or attributes of the elements or factors that make up the research. The results showed that the communal property rights in the native communities of the Chazuta district have been constantly violated by the lack of delimitation, demarcation and ownership of their lands and by the processes of occupation through the concessions granted by the state itself.
