Hegel`in hukuk felsefesi ve özgürlük

Abstract

Hegelian philosophy, as a whole, has concept of freedom as a problematic. It is possible to find a clue about freedom at each and every piece of the system. But freedom makes a summit in Philosophy of Right. Abstract right, morality and ethical life correspond to three moments of the will, respectively, universality, particularity and individuality. Freedom, following the above systematization, reaches at its ultimate point in ethical life which captures family, civil society and state. State is the final moment of the last triolog. In this research we will follow the path which freedom takes in Philosophy of Right. In the end, we will determine that state is not a crysalization of power but a metaphysics of freedom. Fort this, we will ask whether freedom gets realized in the intersection of the universal and the particular as Hegel puts forward. Meanwhile, we will try to answer the questions of whether principle of freedom is desire or reason, act or property. Hegel felsefesi bir bütün olarak özgürlük kavramını kendine mesele edinmiştir. Sisteminin her parçasında özgürlüğün izine rastlamak mümkündür. Ama özgürlüğün bir zirve olarak ele alındığı eseri Hukuk Felsefesi?dir. Soyut hukuk, öznel ahlâklılık ve etik yaşam dünyası olarak iradenin üç momentine, sırasıyla evrenselliğe, tikelliğe ve bireyselliğe tekabül eden bir şekilde ele alınan özgürlük kavramsallaştırması diyalektik olarak en üst aşamasına aile, sivil toplum ve devleti içeren etik yaşam dünyasında ulaşır. Son üçlemenin nihai noktası ise devlettir.Bu araştırmada özgürlüğün Hukuk Felsefesi boyunca aldığı yol izlenecektir. Sonuçta devletin bir güç odağı değil ama bir özgürlük metafiziği olduğu tespit edilecektir. Bunun için özgürlüğün Hegel?in iddia ettiği gibi evrensel ile tikelin buluştuğu noktada tecelli edip etmediği incelenecektir. Aynı zamanda Hegelci özgürlüğün ilkesi arzu mu akıl yahut eylem mi mülkiyet mi sorularına da bir yanıt aranacaktır. Bu irdelemeler sırasında negatif ve pozitif özgürlük kavramsallaştırmaları kılavuz olacaktır.Anahtar kelimeler: Özgürlük, hukuk, hukuk felsefesi, etik yaşam dünyası, ahlâk, arzu, akıl, eylem, mülkiyet, negatif özgürlük, pozitif özgürlük, ?Tinsel Hayvanlar Âlemi?, Efendi-Köle diyalektiği.
