YUNANİSTAN ANAYASASINA GÖRE DEVLET KİLİSE İLİŞKİSİ

Abstract

All Greek constitutions without exception have regulated State-Church relations. At present, articles 3, 13 and 105 of the Greek Constitution are highly relevant and important for this purpose. The Greek Constitution regulates not only the relations between the Greek State and the Orthodox Church in Greece, but also the relations between the Greek State and the Archbishop of Istanbul in Turkey. In so doing, it aims to create international legal personality and rights for the Archbishop of Istanbul. Greek claims for “Ecumenical Patriarchate” in Istanbul are actually related neither with religious freedoms nor the freedom of consciousness. These claims are rather political and concerned more with the management of Orthodox Churches

Yunanistan’ın ilk Anayasasından günümüze kadarki bütün Anayasalarında Kilise ile Devlet ilişkileri düzenlenmiş bulunmaktadır. Yunanistan Anayasasının özellikle 3., 13. ve 105. maddeleri bu bağlamda önemlidir. Yunanistan Anayasası sadece Yunanistan’daki Ortodoks Kilisesi ile Yunanistan Devleti arasındaki İlişkileri değil, Türkiye’deki İstanbul Başpiskoposluğu arasındaki ilişkiyi de düzenleyerek, uluslararası hukuk tüzel kişiliği kazandırılmaya çalışılmaktadır. Yunanistan’ın “Ekümenik Patrikhane” iddiaları, din ve vicdan özgürlüğü ile ilgili değildir. Kiliselerin idaresi ve siyasetle ilgilidir
