Abstract

In the present time, human rights seem to be more and more recurring in political discussions. Furthermore, the ways for their real effectuation are obstructed by interests foreign to the ideas of equality, citizenship and social justice, suscitated by the very formulae of human rights. Would these interests, referring mainly to economic and technical imperatives of a globalized society, invalidate the defense of human rights? By the other way, would not this critique hit the target when addressed to the intransigent defenders of the rights? The aim of this work is to investigate what could be the possible causes for the difficulties of equating, in modern societies, the instance of fundamental rights and the legitimization of the State nation’s power, which many times seems against to the signification of the historical institution of these rights. Through the discussion about the grounds of the rights, we intend to understand what is the meaning of the transformations occurred in the individual and society representations that permitted the emergence and also the refusal of human rights

Na atualidade, os direitos humanos parecem ser um tema cada vez mais recorrente nas discussões políticas. Como se não bastasse, os caminhos para a sua efetivação real encontram-se obstruídos por interesses alheios às idéias de igualdade, cidadania e justiça social suscitadas pela própria fórmula dos direitos humanos. Tais interesses, referentes principalmente aos imperativos econômicos e técnicos de uma sociedade globalizada, invalidariam a defesa desses direitos? Por outro lado, tal crítica não acertaria o alvo quando dirigida aos seus defensores intransigentes? O objetivo deste trabalho é investigar quais seriam as possíveis causas para as dificuldades de se equacionar, nas sociedades modernas, a instância de direitos fundamentais e a legitimação do poder do Estado que, muitas vezes, aparece contrário ao significado da própria instituição histórica desses direitos. Através da discussão sobre os seus fundamentos, pretendemos entender qual o sentido das transformações ocorridas na representação do indivíduo e da sociedade que permitiram a emergência e também a recusa dos direitos humanos
