Abstract

Las normas de intervención humanitaria fueron estructuradas en un contexto normativo y político internacional. En el escenario posterior a la Guerra Fría, seguido de eventos históricos de atrocidades masivas contra civiles en la década de 1990, las normas y el debate sobre las intervenciones humanitarias han adquirido notoriedad. En esta coyuntura, el principio de Responsabilidad de Proteger (R2P) surgió en 2001, a través de la elaboración de la Comisión Internacional sobre la Intervención y la Soberanía Estatal (ICISS), y se consolidó como un principio del Derecho Internacional, en 2005, en la Cumbre Mundial de las Naciones Unidas. Su punto de inflexión se dio por medio de la Resolución 1973 en 2011, emanada por el Consejo de Seguridad, que condujo a la intervención en Libia. En respuesta a los excesos y fallas que ocurrieron durante la implementación de la resolución, Brasil, en una iniciativa como emprendedor normativo, propuso la Responsabilidad al Proteger (RwP). En este sentido, el presente trabajo tiene por objeto identificar cómo esta propuesta normativa de RwP se inserta en el amplio panorama de la evolución de las normas de intervención humanitaria, es decir, en el entorno político y normativo internacional. Así, RwP se abordará como un ejemplo de un intento normativo inmerso en el ámbito internacional de las reglas sobre el uso de la fuerza, enfatizando el carácter propositivo de esta que surge de la falta de esfuerzo de Brasil en consolidar el concepto dentro del alcance de las Naciones Unidas.

As normas de intervenção humanitária se estruturam num contexto normativo e político internacional. No cenário pós-Guerra Fria, seguido de acontecimentos históricos de atrocidades em massa contra civis, ocorridos na década de 1990, as normas, assim como o próprio debate em torno das intervenções humanitárias, adquiriram notoriedade. Nesta conjuntura surgiu, em 2001, o princípio da Responsabilidade de Proteger (R2P), por meio da elaboração da Comissão Internacional sobre a Intervenção e a Soberania Estatal (ICISS), e se consolidou como princípio do Direito Internacional em 2005, na Cúpula Mundial das Nações Unidas. Seu ponto de inflexão se deu por meio da Resolução nº1973 no ano de 2011 – emanada pelo Conselho de Segurança da ONU– que redundou na intervenção na Líbia. Em resposta aos excessos e falhas ocorridos durante a implementação da resolução, o Brasil, numa iniciativa como empreendedor normativo, propôs a Responsabilidade ao Proteger (RwP). Neste sentido, o presente trabalho visa identificar como se insere esta proposta normativa da RwP no vasto panorama da evolução das normas de intervenção humanitária, isto é, no meio político e normativo internacional. Assim, a RwP será abordada como exemplo de uma tentativa normativa imersa no escopo internacional das regras sobre o uso da força, ressaltando-se o caráter propositivo desta, decorrente da falta de esforço do Brasil em consolidar o conceito no âmbito das Nações Unidas.

The norms of humanitarian intervention are structured within an international normative and political context. In the post-Cold War scenario, followed by the historical events of mass atrocities against civilians in the 1990s, the standards and the debate on humanitarian interventions have gained notoriety. At that juncture, the principle of Responsibility to Protect (R2P) emerged in 2001, through the elaboration of the International Commission on State Intervention and Sovereignty (ICISS), and was consolidated as a principle of international law in 2005 at the UN World Summit. Its turning point came through Resolution 1973 in 2011 - issued by the Security Council - which resulted in the intervention in Libya, in response to the excesses and failures that occurred during the implementation of the resolution. Brazil in an initiative as a normative entrepreneur, proposed Responsibility while Protect (RwP). In this sense, the present work aims to identify how this RwP normative proposal fits into the vast panorama of the evolution of humanitarian intervention standards, that is, in the international political and normative environment. Therefore, the RwP shall be approached as an example of a normative attempt immersed in the international scope of the standards on the use of force, emphasizing its propositional character due to Brazil's lack of effort to consolidate the concept within the framework of the United Nations.
