O estupro no direito romano

Abstract

O stuprum per vim no direito romano, ou estupro, como o conhecemos, é profundamente analisado nesta obra, de Kelly Cristina Canela, que reconstrói essa figura penal tal como era concebida na Roma Antiga. Para a autora, as constantes citações do stuprum per vim na literatura não jurídica, como as produzidas por filósofos, historiadores e escritores da Roma Antiga, sugerem a existência de regulamentação jurídica exaustiva acerca do crime no direito romano. No entanto não se encontra na legislação romana leis específicas sobre o assunto, inexistindo inclusive a figura do estupro como conceito autônomo. Nesse contexto, a autora analisa com profundidade interpretações de diversos autores sobre o conceito de stuprum e como o direito romano tratava o crime, inclusive em termos de repressão. Com foco na posição da mulher, Canela discorre sobre a organização social da Roma Antiga e dedica um capítulo todo à exegese de textos da legislação e de juristas romanos que tratam da aplicação da lei na repressão do stuprum per vim. A obra também oferece subsídios jurídicos históricos para reflexões sobre a legislação penal brasileira sobre crime de estupro, especialmente em relação às leis 11.106/05 e 12.015/09.
