El multiculturalismo es una situación de hecho incuestionable. Las Constituciones democráticas proclaman el pluralismo como un bien o valor constitucional y los derechos fundamentales como fundamento del orden político. El conflicto, sin embargo, puede plantearse cuando determinados colectivos reivindican costumbres y prácticas que colisionan con los valores comunes de una sociedad. Teniendo en cuenta que, en muchas ocasiones, el derecho fundamental que se invoca para legitimar esas costumbres o prácticas es la libertad religiosa, el presente trabajo analiza y somete a crítica la jurisprudencia del Tribunal Constitucional español y del Tribunal Europeo de Derechos Humanos en torno al contenido constitucionalmente declarado del derecho enunciado en el artículo 16 de nuestra Constitución y en el artículo 9 del Convenio Europeo de Derechos Humanos y, en definitiva, reflexiona sobre el alcance y límites de la multiculturalidad en el Estado democrático.
Multiculturalism is a real fact. Constitutions enunciate pluralism as a constitutional value and provide that fundamental rights are the foundation of political order. Nevertheless, the conflict can arise when certain groups claim customs or practices against the social common values. Having in mind that religious freedom is the fundamental right usually invoked to legitimize these customs and practices, this article analyzes the case law of the Spanish Constitutional Court and the European Court of Human Rights about the content of this right (arts. 16 SC and 9 ECHR) and, as a last resort, tries to think about the scope and limits of multiculturalism in a democratic State.
