El presente trabajo se adentra en el debate doctrinal en tomo a la relación que media entre laicidad y cooperación (art. 16.3 CE). Una relación, por así decir, dialéctica, de tensiones e influencias mutuas, de suerte que la laicidad queda perfilada por la cooperación, y viceversa. Teniendo en cuenta el alto nivel de abstracción de ambos principios, el análisis de la jurisprudencia constitucional será herramienta imprescindible a la hora de centrar la reflexión. En la última parte del trabajo, se enjuicia, desde la perspectiva constitucional, el marco normativo actual de la libertad religiosa y cooperación entre el Estado y las confesiones.
This article focuses on the relationship between securalism and cooperation (art. 16.3 SC). This relationship may be defined in terms of a dialectical or mutual influence. Secularism affects cooperation and vice versa. Considering the high level of abstraction of secularism and cooperation, it will be analyzed the way in which the Constitutional Court has shaped and specified the meaning ofboth principles. Finally, has it improved the Spanish legislation on cooperation between the state and churches?.
