En este trabajo se sintetiza la evolución del concepto constitucional de laicidad en la jurisprudencia constitucional colombiana, insistiendo en la importancia que la idea de neutralidad ha tenido en esa evolución. De forma particular, se analizará la reciente jurisprudencia de 2016 en aplicación del principio de laicidad del Estado, en la que la Corte Constitucional asume, en buena medida, el test de constitucionalidad empleado por la Corte Suprema norteamericana en aplicación de la Establishment Clause.
This paper summarizes the evolution of the constitutional concept of separation between State and Church in Colombian constitutional jurisprudence, focusing on the importance that the idea of neutrality has had in that evolution. In particular, the recent jurisprudence of 2016 will be analyzed regarding the application of the principle of secularity of the State, in which the Constitutional Court applies the test of constitutionality used by the US Supreme Court in application of the Establishment Clause.
