Costes e incertidumbres del sistema fiscal: una cuantificación de la conflictividad tributaria

Abstract

El funcionamiento de un sistema fiscal, en lo que concierne tanto a facilitar el cumplimiento voluntario de las normas tributarias como a disuadir su incumplimiento, comporta costes e incertidumbres que pueden afectar drásticamente a la efectividad pretendida por aquél, aconsejar cambios importantes e incluso cuestionar el diseño básico del sistema fiscal. A pesar de su aparente importancia, sabemos muy poco -de forma sistemática- sobre estos conflictos, sobre qué materias versas, cuál es su cuantía, quién recurre y contra quién, cuál es el signo de los fallos que se producen a lo largo de las distintas instancias en que se procesan, cuánto invierten las partes en la defensa de su caso, cuánto dura y cuánto cuesta (a todos) su resolución, quién gana o pierde... Responder a esas preguntas nos permite aproximar el valor de los costes totales esperados de la resolución de los conflictos. Ése es el objeto de este trabajo, que además comenta algunas de sus implicaciones para la política fiscal.
