Abstract

El crédito público disfrutaba en la normativa anterior a la Ley 22/2003 de 9 de julio, Concursal, de una situación privilegiada, ya que disponía de un régimen especial y los procedimientos recaudatorios se continuaban sobre el patrimonio del concursado, salvo que la declaración de suspensión de pagos fuese de fecha anterior a la providencia de apremio. La Ley Concursal se propone conjugar los principios de mantenimiento de la actividad y el de “par conditio creditorum”, con la especificidad del crédito que ostenta la Administración por el interés público. Esto exige el recorte de los privilegios del crédito público, que se logra a partir de la clasificación de los créditos en extraconcursales y concursales, sean con privilegio especial o general, ordinarios y subordinados, manteniéndose las preferencias exclusivamente en los privilegiados, reducidos en número y cuantía, de modo que un mismo crédito puede tener distintas clasificaciones. Por esta razón se genera un diferente tratamiento en las distintas fases del concurso que examinamos, “Declaración de concurso”, “Fase común”, “Fase de convenio” y “Fase de liquidación”, haciendo hincapié en los privilegios sustantivos y procesales que subsisten tras la Ley.
